1. Acceptance of Terms
By accessing, browsing, or utilizing the Crater platform or joining our waitlist, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service. If you do not agree to these terms in their entirety, you must not use our services, site, or waitlist.
2. Waitlist and Access Conditions
Joining the Crater waitlist does not constitute an offer, contract, or guarantee of immediate, delayed, or future access to the Crater platform or any associated products. Access is granted at our sole and absolute discretion. We reserve the right to modify, suspend, or discontinue the waitlist, platform access, or any associated features at any time, with or without notice.
3. Intellectual Property Rights
All intellectual property rights, including but not limited to copyrights, trademarks, service marks, trade secrets, algorithms, designs, brand elements, and software code related to Crater, are the exclusive property of the Crater team and its licensors. You are granted no right or license to reproduce, modify, distribute, create derivative works of, publicly display, or otherwise utilize these assets without explicit, prior written permission.
4. User Conduct and Responsibilities
You agree to use the waitlist and platform for lawful purposes only. You must not: (a) provide false, inaccurate, or misleading information; (b) attempt to gain unauthorized access to our systems; (c) interfere with the proper functioning of our services; or (d) engage in any activity that could damage, disable, or impair our infrastructure.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Crater, its founders, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses resulting from: (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your transmissions or content. Crater is provided on an "as is" and "as available" basis without any warranties, express or implied.
6. Indemnification
You agree to defend, indemnify, and hold harmless Crater and its associates from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the waitlist or platform.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Crater operates, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
